Pedophilia Is Now Legal In California?
A September 1, Facebook post which has been shared over thirteen thousand times already has claimed that there is now a law in place which makes pedophilia legal in the State of California.
The viral post reads, ‘PEDOPHILIA is now LEGAL in CALIFORNIA. SB-145 passed! Now a 21 year old can have sex with an 11 year old, and not be listed on the sex registry as a sex offender. This is unbelievable California’. How true is this claim?
FakeZap can confirm that this claim is unfounded and false. While it is true that a bill known as SB-145 was recently passed, and the bill contains a number of amendments as it relates to various sexual offenses, there is no part of the bill which expressly or implicitly made pedophilia legal in the state of California.
What the bill has done is to allow a sitting judge to decide whether to register those convicted of having voluntary anal or oral sex with a minor in the sex offender registry. Also, for this to happen, the age difference between the offender and the victim must be up to 10 years.
The current bill in place empowers a judge to decide whether to place a young man who is convicted of statutory rape, in which vaginal intercourse takes place with a minor on the sex offender registry. However, there is no provision in place for oral and anal sex, which a lot of people consider unfavorable to the LGBTQ community.
This new bill didn’t make any changes to the age of consent in California, which is still 18, and it hasn’t reversed the statutory punishment for pedophilia or rape. Instead, this bill only sought to rule out automatic registration of young adults who have been convicted of having ‘voluntary’ oral or anal sex with a minor. It is also important to note that, both parties have to admit to the fact that, the sexual acts being mentioned above were done voluntarily for this bill to be effective.
While there have been a lot of public outcries such as this, against this bill since it was passed by the California legislation, it is important to say that the bill does not in any way give consent to pedophilia. As of the time of writing, pedophilia is still considered a serious offense in California, and this means, this social media post is false.
